Overview

This website and store are operated by Hawaii Stream LLC under the UPOPN brand. Throughout these Terms, “UPOPN,” “we,” “us,” and “our” refer to Hawaii Stream LLC. These Terms of Service govern your use of this website, its content, and any products or services that may later be offered through it.

UPOPN is currently in Limited Pre-Launch. Online ordering remains closed unless a product page and checkout expressly state that a product is available for purchase. By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

Eligibility and account information

You must be able to enter a binding agreement in your jurisdiction to make a purchase. If ordering becomes available, you agree to provide current, complete, and accurate billing, shipping, payment, and contact information. You are responsible for activity conducted through your account and for protecting your account credentials.

Products, collection imagery, and availability

We work to present product descriptions, colors, measurements, imagery, and availability accurately. Screen settings, photography, and production variation can affect appearance. Illustrated or editorial collection imagery may communicate design direction and is not a substitute for the specifications shown on an available product page.

Products may be released in limited quantities or during stated order windows. Availability is not guaranteed until an order is accepted. We may correct errors, revise descriptions, limit quantities, decline an order, or withdraw a product where reasonably necessary. Any stated limited quantity or release window will be genuine.

Orders and payment

Submitting an order is an offer to purchase. An order is accepted only after payment authorization and an order confirmation from UPOPN. We may decline or cancel an order for suspected fraud, payment failure, inventory error, pricing error, shipping restriction, or another lawful reason. If we cancel an accepted paid order, we will issue the applicable refund.

Prices are shown in the currency displayed at checkout. Taxes, shipping, duties, and other charges will be shown where applicable before the order is submitted. UPOPN does not promise recurring discounts or restocks.

Shipping, returns, and refunds

Shipping and delivery are governed by the Shipping Policy displayed at checkout. Delivery dates are estimates unless expressly stated otherwise. Returns, exchanges, cancellations, and refunds are governed by the Return and Refund Policy in effect when the order is placed. Nothing in these Terms limits non-waivable consumer rights.

Intellectual property

The UPOPN name, wordmarks, monograms, artwork, collection concepts, photographs, video, graphics, text, layout, and original site content are protected by applicable trademark, copyright, and other laws. Access to the website does not grant a license to copy, reproduce, modify, distribute, sell, or commercially exploit any protected material without prior written permission.

Acceptable use

You may not use this website unlawfully; interfere with its security or operation; introduce malicious code; impersonate another person; collect information about others without authorization; infringe intellectual-property or privacy rights; or use automated systems in a manner that violates posted access restrictions or applicable law.

Third-party services and links

The store may rely on third-party services for hosting, payment processing, communications, analytics, or order support. Those providers may process information as described in our Privacy Policy. Third-party websites and services are governed by their own terms. Purchases from UPOPN are transactions with UPOPN, not with our commerce-platform provider.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the website and pre-launch content are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. To the fullest extent permitted by law, Hawaii Stream LLC will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the website. These limitations do not exclude liability or rights that cannot lawfully be excluded.

Governing law

These Terms are governed by applicable United States federal law and the laws of the State of Hawaii, without limiting mandatory consumer protections that apply in your place of residence.

Changes

We may update these Terms by posting a revised version and effective date. Material changes will apply as required by law. The terms shown when an order is placed will govern that order.
